Two-Stage Process
Subclass 820 Visa (Temporary)
“The initial temporary visa is granted while your permanent visa application is processed. This visa allows you to live, work, and study in Australia.”
Subclass 801 Visa (Permanent)
“After a waiting period (typically two years from the date of your initial application), you may be eligible for this permanent visa provided your relationship is still ongoing.”
Essential Criteria for the Applicant
- Must have an Australian sponsor, such as a de facto partner or spouse.
- Must be at least 18 years old (exceptions may apply).
- Must be in a genuine and ongoing relationship with an Australian partner or spouse.
- Must be in Australia when submitting the application.
- Must hold a substantive visa at the time of application or provide compelling and compassionate reasons for your visa request.
- Must meet health and character requirements.
Essential Criteria for the Australian Sponsor
- Must be an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen.
- Must not have sponsored another person for a partner visa within the past five years.
- Must not have been sponsored for a partner visa within the past five years.
- Must not have sponsored more than two individuals for a partner visa.
- Must meet character requirements.
Duration of Stay
- Subclass 820: Temporary visa holders can stay until the permanent partner (subclass 801) application is processed or withdrawn.
- Subclass 801: Visa holders can stay indefinitely and travel in and out of Australia freely for five years. They may apply for Australian citizenship if eligible.
